These terms cover your use of CommercialBER.ie and the purchase of our digital products. Assessment services (BER certificates, DECs, audits) are quoted and agreed individually; the engagement terms for those are confirmed with your quote.
Quotes are free and carry no obligation. When you submit a quote form we aim to call you back within 24 hours with a firm price. Assessment timelines we state (such as certificates typically registered within 48 hours of survey) are targets we hit in the normal run of things, not contractual guarantees: access issues, documentation gaps and SEAI processing can move dates, and we tell you promptly when they do.
The Commercial Landlord’s Compliance Pack and the Commercial BER Improvement Roadmap are digital products delivered by download or email. Prices shown are in euro and inclusive of VAT where applicable; a VAT receipt is available on request.
14-day refund. If a digital product is not useful to you, reply to your receipt or email info@commercialber.ie within 14 days of purchase and we will refund you in full. For the Roadmap, if we cannot produce a useful report from your answers, we refund you and say so without being asked.
Licence. Purchases are for your own use and your own organisation’s use. Please do not redistribute or resell them; they are priced so you do not need to.
Updates. Where a product promises updated editions, they are sent free to the email address used at purchase.
Content on this site and in our digital products is practical guidance prepared with care by a SEAI-registered assessor, reflecting the law and market as at the date stated. It is not legal advice and it is not a certified BER assessment: regulations change, buildings differ, and only a registered assessment of your building produces an official certificate and advisory report. For contentious or high-stakes matters, brief your solicitor.
The Roadmap is prepared from the information you provide in the questionnaire, built on our assessment methodology. Its cost figures are clearly-labelled indicative ranges, not quotations, and its recommendations should be confirmed by a certified assessment before capital is committed. Where we promise the Roadmap fee as a credit against a subsequently booked assessment, that credit applies to assessments booked with us.
Nothing in these terms limits liability that cannot be limited under Irish law. Beyond that, our liability in connection with a digital product is limited to the price you paid for it, and we are not liable for decisions taken on guidance without the certified assessment the guidance itself tells you to obtain.
These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction.
